1. Scope

These general terms and conditions apply to all orders placed by consumers via the online shop xeachwear.com at:

(hereinafter referred to as “Provider”)

A consumer within the meaning of these conditions is any natural person who concludes a legal transaction for purposes that cannot be predominantly attributed to either their commercial or independent professional activity.

2. Contractual partner & conclusion of contract

The presentation of the products in the online shop does not constitute a legally binding offer, but rather a non-binding invitation to order.

By clicking the order button, you make a binding offer to purchase the goods contained in your shopping cart.

The purchase contract is concluded as soon as you receive an order confirmation by email.

3. Prices & Payment Terms

All prices are stated in euros (or the respective shop currency) and include VAT, if applicable.

Shipping costs are shown separately in the ordering process.

The debit takes place immediately after the order is placed.

4. Delivery & Shipping

Delivery is made internationally to the address provided by the customer.

The regular delivery time is 5-10 working days from order confirmation, unless otherwise stated.

In the event of delivery delays, the customer will be informed immediately.

5. Retention of title

The goods remain the property of Xeach until full payment has been made.

6. Right of withdrawal

Consumers have a statutory right of withdrawal 14 days to.

7. Warranty

The statutory warranty rights apply.

Obvious defects must be reported within 7 days of receipt of the goods.

8. Liability

Xeach is fully liable for damages arising from:

Injury to life, body or health
intentional or grossly negligent breach of duty

In the event of slight negligence, Xeach is only liable for breach of essential contractual obligations and is limited to foreseeable damage.

9. Care & Use of Swimwear

Our products are delicate designer pieces. Care instructions must be followed.

Xeach assumes no liability for damage caused by improper use or care.

10. Copyrights

All content of the online shop (designs, photos, texts, brands) are protected by copyright and may not be used without written consent.

11. Data Protection

Information on the processing of personal data can be found in our Privacy Policy.

12. Dispute Resolution

The European Commission provides a platform for online dispute resolution:

Xeach is not obliged to take part in dispute resolution proceedings before a consumer arbitration board.

13. Applicable Law

The law of the country in which Xeach has its registered office applies, excluding the UN Convention on Contracts for the International Sale of Goods.

Mandatory consumer protection regulations in the country of residence remain unaffected.
